The fair work act : two years on : a review of Labor's changes to workplace laws /

by Australian Council of Trade Unions.

Publisher: Melbourne, Vic. Australian Council of Trade Unions 2011Description: PDF.Other title: Working Australia Paper 5/2011.Online Access: Electronic copy Notes: July 2011 "ACTU D 31/2011" INTO AND OUT OF WORKSummary: This report evaluates whether the Fair Work Act has delivered for working people and their families. The end of WorkChoices was the culmination of an unprecedented campaign for all working Australians - that unions and our community fought hard for and are proud of - to restore rights at work. Restoring rights at work meant: an end to Australian Workplace Agreement individual contracts; unfair dismissal protections for all workers; a stronger safety net; good faith bargaining; and, the return to an independent umpire to resolve disputes. The second anniversary since the Fair Work Act began operation provides an opportunity to examine the impact of these laws on working Australians and the economy. This extensively researched report comprehensively debunks the myths and misinformation being circulated by employer groups and the Liberal Party to bolster their case for a return to WorkChoices.Availability: (1)

Vulnerability in the fair work-place : why unfair dismissal laws fail to adequately protect labour-hire employees in Australia /

by Malone, Trina | Melbourne University.Centre for Employment and Labour elations Law.

Publisher: Melbourne, Vic. Melbourne University.Centre for Employment and Labour Relations Law 2011Description: PDF.Other title: Melbourne University. Centre for Employment and Labour.Online Access: Electronic copy Notes: May 2011 Bibliography : p. 25-30 INTO AND OUT OF WORKSummary: Labour-hire employees (LHEs) do not have effective recourse to unfair dismissal laws against their employers where they have lost access to their livelihood in circumstances that are substantively or procedurally unfair. This paper provides a critique of tribunal decisions relating to unfair dismissals against employer labour-hire firms (LHFs). Such decisions highlight three key problems for LHEs in establishing each component of the definition of an unfair dismissal. First, a termination of a host assignment will not necessarily constitute a termination of the employment relationship with the LHF. Second, the host's reasons for the termination of the assignment are considered to be largely irrelevant, even if unfair. And third, tribunals are willing to accept a low standard of procedural fairness where the contractual arrangements between the LHF and the host do not provide for the implementation of a fair dismissal procedure. The paper concludes that LHEs who have lost their livelihood in unfair circumstances may 'slip' through the net of legislative protection by failing to meet the definition of an 'unfair dismissal'.Availability: (1)
